I. Goal

Administration for Digital Industries, Ministry of Digital Affairs specially planned and established the AI technical service capability classification and registration mechanism to improve the AI development environment in Taiwan, hoping to take stock of domestic AI technical service capabilities through a credible classification and registration mechanism. It compiles a map of the domestic AI industry, and assists AI service providers with developing more competitive products and services, in order to expand industrial services and scale, accelerate the application of AI in the industry, and increase industrial value.

II. Definition of technical scope

The definition of AI in the capability registration refers to the realization of simulated human cognition, machine autonomous inference, or knowledge work abilities in specific fields or general fields through new modeling methods, such as machine learning and deep learning. This is used as the core business or integrated it into existing industries, software and hardware integration, or consulting service solutions.

III. Eligibility

Domestic companies established in accordance with the Company Act of the Republic of China with registration approved by the central competent authority, the Ministry of Economic Affairs (MOEA), or partnerships established in accordance with the law to provide professional services.

IV. Application Documents

Please attach one copy of each of the following documents and send them to the Information Service Industry Association Industrial Service Office Section 1 at 8F, No. 99, Sec. 2, Chang'an E. Rd., Zhongshan District, Taipei City 104097 before 17:00 on June 30, 2023 (Friday). (Subject to the time of delivery) Please specify "Application for AI Service Organization Capability Registration" on the envelope.

(I) Application Form and Affidavit for the MODA ADI's 2023 AI Service Organization Capability Registration (see Attachment 1 for the format).

(II) Proposal Form for the MODA ADI's 2023 AI Service Organization Capability Registration (including electronic file, see Attachment 2 for the format).

(III) Required attachments of the proposal:

1. A photocopy of the certificate of company registration or business registration issued by the central competent authority.
2. The most recent tax bill for profit-seeking enterprise income tax, balance sheets, and statement of comprehensive income, or a photocopy of the approval notification for the declaration of income derived from professional practice.
3. Resume of full-time employee.
4. A photocopy of documents proving the performance of AI products or professional services (※ Validity period of performance data: Within 2 years before the deadline).

VII. Composition of the review meeting

The review meeting is convened and hosted by the MODA ADI, and the Information Service Industry Association hires experts and scholars to serve as review committee members.

VIII. Tasks of the review meeting

(I) The review meeting is convened and hosted by the MODA ADI, and review committee members review the contents of application forms of AI service organizations for capability registration:

1. The quality of full-time personnel of AI service organizations.
2. Achievements in AI technical service capability registration items of the application.
3. Execution and management capabilities of the AI company.
4. Financial health of the AI company.

(II) Amendments to review standards.

(III) Other matters that should be reviewed at the meeting in accordance with these must knows.

IX. Review during the review meeting

The review meeting is convened and hosted by the MODA ADI, and the executing organizer of AI service capability registration reviews qualifications based on relevant documents. If the information is found to be incomplete, the applicant will be notified to supplement documents or make corrections within the time limit. If the qualifications and information meet the requirements, it will be sent directly to the review meeting for review.

X. Pass or fail the review meeting

If an applicant passes the qualification review, MODA ADI will convene a review meeting. The executing organizer of AI service capability registration will request a review meeting be convened and notify the applicant to give a presentation and answer questions. (See Attachment 3 for the format of the applicant’s presentation).Resolutions after review by the review meeting include:

(I) Passed the review: The applicant will be notified of the result by letter, and the executive organizer will make an announcement or post the results on the website.

(II) Did not pass the review: Applicants will also be notified of the results by letter.

XI. Review Standards

(I) Eligibility review

General conditions: Domestic companies established in accordance with the Company Act of the Republic of China with registration approved by the central competent authority, the Ministry of Economic Affairs (MOEA), or partnerships established in accordance with the law to provide professional services.

(II) Technical review

Quality of human resources:

1. Human resource: At least three full-time personnel.

2. Graduated from university and above and has at least two years of relevant work experience (four years for junior college and six years for high (vocational) school).

3. If the experience does not meet the above standards, documentation of individual achievements must be provided (such as AI project implementation performance, awards won in domestic and overseas AI-related competitions, industry internships, industry-academia collaboration experience, etc.) and must be reviewed and approved by the review committee before work experience requirements may be waived.

List guidance achievements in the past two years, and provide documents sufficient to prove the capability to implement the technology sub-project (※ Effective period of achievement: Within 2 years before the deadline).

(III) Service review

Financial status:

1. The company's finances are sound and its net worth is not negative.

2. The company applying for registration does not owe any taxes.

AI project experience

1. List the AI-related products, services, or systems that the company took the lead or participated in completing, and achievements in assisting customers with implementation.

2. The achievements listed by applicants must include the same service items to prove their experience and capabilities.

3. Applicants can introduce their services and products in detail, and explain their implementation strategies for future solutions.

XII. Registration

Applicants that pass the review will be registered by the MODA ADI and the executing organizer will make an announcement or post results on the website.

XIII. Effective period of registration

The effective period of AI service organization capability registration is two years. When the period expires, an application may be submitted through written review or meeting review, and the effective period may be extended for two years after passing the review in the review meeting.

XIV. Changes to registered information

(I) If there are any changes to basic information, such as the person in charge, contact person, telephone number, and fax, of the registered company, an application form for change (see Attachment 4) and related documents must be submitted to apply to the executing organizer for change of AI service organization capability registration.

(II) Related documents must be submitted for review to add or change service registration items.

XV. Announce registration related information

Please refer to the website of the MODA ADI and the website of the executing organizer for related regulations, application documents, and information on registered companies.

XVI. Tracking management and appeal mechanism

(I) If there is a material change in a registered AI service organization that is sufficient to affect the contents registered, the executing organizer of AI service organization capability registration shall be notified.

(II) The executing organizer of AI service organization capability registration may irregularly conduct verification or visits related to the contents of registration, and may appoint professionals to assist in the verification when necessary.

(III) If necessary, applicants may file an appeal with the executing organizer, and the executing organizer will respond in writing.

XVII. Cancellation conditions

During tracking management, if the following conduct is confirmed through verification or inspection, the company will be notified to make improvement. If the company fails to make improvements, the company's registration qualification will be cancelled.
(I) The registration information does not match.

(II) There is a major violation.

(III) The registration qualification has expired and resulted in damage to the rights and interests of other companies or owners.

(IV) Other events deemed sufficient for cancellation of qualification by the review meeting for AI service organization capability registration.

XVIII. Penal provisions for cancellation

Companies that canceled its registration may not apply for AI service organization capability registration within two years.
